Account Creation Representation and Warranty:
1. By creating an account with us, you represent and warrant that you have the right, power, and authority to agree to these Terms, to become a party to a legally binding agreement, and to perform your obligations under these Terms.
Providing True and Up-to-Date Information:
2. You agree to provide us with true, complete, and up-to-date information about yourself as may be required to complete the Transactions. This information includes, but is not limited to, personal details such as name, email address, phone number, delivery address, age, and gender, as well as accurate payment information required for the transaction.
Account Responsibility:
3. Upon completing the Website’s registration process, you will receive a password and account designation. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify The Lokal Shop of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. Lokal Shop cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. The security of your Personal Information is of prime importance to us. We have implemented reasonable physical, electronic, and managerial procedures to safeguard the information we collect, including limiting access to the Personal Information contained on our servers. However, due to the inherent open nature of the Internet, we do not guarantee that communications between you and The Lokal Shop, or information stored on the Site or our servers, will be completely free from unauthorized access by third parties such as hackers. Your use of the Site is at your own risk.

5. You agree that we may collect, store, and share the information provided by you to deliver the products and/or services availed by you on our Platform and/or to contact you in relation to the same.

● Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
● Interfere with, disrupt, or create an undue burden on the Platform or the networks or services connected to the Platform.
● Use the Platform as part of any effort to compete with us or otherwise use the Platform and/or the Content for any revenue-generating endeavor or commercial enterprise.
● Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Platform to you.
● Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Platform.
User Reviews:
7. We may provide areas on the Platform for you to leave reviews or ratings. When posting a review, you must comply with the following criteria:
● You should have firsthand experience with the person/entity being reviewed.
● Your reviews should not contain offensive language, discriminatory references, or references to illegal activity.
● You should not be affiliated with competitors if posting negative reviews.
● You should not make any false or misleading statements.
● You may not organize a campaign encouraging others to post reviews, whether positive or negative.
We reserve the right to accept, reject, or remove reviews at our sole discretion. Reviews are not endorsed by us and do not necessarily represent our opinions or the views of any of our affiliates or partners.
Governing Law and Jurisdiction:
8. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Any dispute shall be referred to and finally resolved by arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be India, and the arbitration proceedings shall be conducted in English.
Errors and Omissions:
9. We try to ensure that all details, descriptions, and prices appearing on this Website are accurate, but errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as canceled. If you cancel and have already paid for the goods, you will receive a refund up to the price of the goods.

Delivery Timeline:
10. Delivery costs will be charged in addition to the price of the goods, and such additional charges are clearly displayed where applicable and included in the Total Cost. The delivery timeline for your orders will be a minimum of 5 days and a maximum of 20 days from the date of order confirmation.

Indemnity:
You shall indemnify and hold harmless The Lokal Shop, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Limitation of Liability:
In no event shall The Lokal shop be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if the user has been informed in advance of the possibility of such damages.

Delivery costs will be charged in addition to the price of the goods, and such additional charges are clearly displayed where applicable and included in the Total Cost.
Please review these Terms carefully before using our services. Your use of our services signifies your agreement to these Terms. If you do not agree to these Terms, you must not use our services.
